General Terms and Conditions
General information:
“EscapeGame-Munich” is a team game for people aged 10 to 99 and is operated by KiHa GmbH. Children up to the age of 14 can only participate if accompanied by an adult. From the age of 14, the presentation of a Declaration of consent des jeweiligen Erziehungsberechtigten.
Important:
Tickets cannot be exchanged for cash.
KiHa GmbH is obliged to provide the service ordered and confirmed by it in writing.
The customer is obliged to pay the prices agreed for these services.
The agreed prices include the applicable statutory value added tax.
The description of the services on the KiHa GmbH website does not constitute an offer to conclude a contract.
All online descriptions of “EscapeGame-Munich” are subject to change. In the event of the unavailability of the entire offer or individual elements, KiHa GmbH is not obliged to make good the service.
Booking conditions
1. Booking:
All persons listed in the booking must have given the person responsible for the group their authorization to make the booking prior to booking.
Underage group members must present the consent of their parents or legal guardians. Timely payment is the responsibility of the group leader. They must be of legal age at the time of booking.
1.1 Bookings
Bookings can be made via our website www.escapegame-augsburg.de.
When booking, the initial confirmation is made by assigning a booking number. The booking is then confirmed again by e-mail, with the confirmation e-mail being sent to the e-mail address provided at the time of booking. The confirmation serves as proof of the booked offer. The customer must check the information in the booking confirmation for completeness and accuracy upon receipt. The KiHa GmbH team must be notified immediately of any errors or incompleteness, as subsequent changes are not possible.
Spontaneous bookings on site are only possible if there is free capacity.
2. Payment:
Cashless payment via PayPal or by bank transfer (for bookings by email) possible. Both cash and card payments are accepted on site.
In the case of spontaneous bookings, the entire contractually agreed amount must be paid in cash before the service is provided.
3. Contract:
The assignment of the booking number creates a binding contract between KiHa GmbH and the customer.
Only services that are explicitly mentioned in the online offer on which the booking is based are the subject of the contract. Additional services require a special agreement. An additional fee may be agreed for such services.
4. Vouchers:
1) Vouchers purchased from us can only be redeemed once.
2) If there is a remaining amount, it expires and can no longer be used.
In the event of a price increase, the voucher retains its original value. The number of participants stated on the voucher can no longer be credited in full. The additional amount of the new prices can be paid directly on site.
Example: You have a voucher for 4 people (paid value 108 €). The new price for 4 players is 120 €. In this example, you can pay the difference of 12 € directly on site.
5. Cancellations changes by the customer:
The customer has the option of canceling or rebooking the game free of charge up to 48 hours before the start of the game (with the exception of company events in the high season: from September to March. 5.1.
Stornierungen & Änderungen des Termins:
KiHa GmbH reserves the right to cancel bookings that have already been confirmed for internal reasons. In such cases, the remuneration paid will be refunded within a period of 1 week.
If the required advance payment is not made even after a reasonable grace period set by “EscapeGame-Munich” has expired or is subsequently canceled by the customer, KiHa GmbH is entitled to withdraw from the contract.
6. Restrictions on use
Persons with infectious and/or contagious diseases and persons who are under the influence of intoxicating substances are not permitted to use the facilities.
Persons with a tendency to seizures or fainting spells as well as mentally and physically severely disabled persons are only permitted to use and stay in the park if accompanied by a supervisor.
Serious physical illnesses that could significantly impair the use of the games on offer (epilepsy, cardiovascular diseases, etc.) and mental illnesses in the form of perceptual disorders must be reported. KiHa GmbH reserves the right to refuse use in exceptional health cases.
Animals are not permitted.
7. Liability of the contracting parties
7.1.
KiHa GmbH’s liability for defects in performance shall be limited to defects attributable to intent or gross negligence. The customer is not entitled to a reduction. This shall not affect the customer’s right to rectification of defects.
Claims for damages and reimbursement of expenses on the part of the customer, irrespective of the legal grounds, in particular for breach of duties arising from the contractual obligation and from tort, are excluded. This does not apply if liability is mandatory, e.g. under the Product Liability Act, in cases of intent, gross negligence, injury to life, limb or health, or breach of material contractual obligations.
However, the claim for damages due to essential contractual obligations is limited to the foreseeable damage typical for the contract, unless there is intent or gross negligence or liability for injury to life, limb or health. This does not imply a change in the burden of proof to the detriment of the customer.
7.1.1 Personal items
Any personal items carried by the customer are kept in the play and recreation rooms at the customer’s own risk. KiHa GmbH accepts no liability for loss, destruction or damage, except in cases of gross negligence or intent on the part of KiHa GmbH or its employees.
7.2.
KiHa GmbH shall not be liable for damage caused by force majeure, riots, acts of war and natural disasters or other events for which it is not responsible (e.g. strike, lockout, traffic disruption, orders from higher authorities at home or abroad) or technical faults (such as the IT system) for which it is not responsible.
Computer viruses or deliberate attacks on IT systems by “hackers” shall also be considered force majeure, provided that appropriate protective measures have been taken against them.
7.3.
The customer shall be liable for all damage to buildings or inventory caused by him or third parties from his area.
8. Complaints:
KiHa GmbH employees must be contacted immediately in the event of complaints. Any verbal notification must be followed up in writing as soon as possible.
Complaints must be submitted within 14 days of visiting the attraction, stating the booking number.
9. Recording:
KiHa GmbH reserves the right to record individual calls and evaluate emails for training purposes and to improve the standard of service. In addition, the game rooms are video-monitored for security purposes and for the purpose of coordinating the game. Photos and video recordings are taken at individual games for advertising purposes. By making a corresponding note on the waiver, the customer declares their agreement to this.
10. Arrival, parking facilities:
Arrival is the sole responsibility of the customer.
KiHa GmbH does not provide parking spaces for its visitors.
11. Delays:
“EscapeGame-Munich” games are live events. As the rooms are specially prepared for each booking and reserved for the booked period, the customer must arrive on time for the booked period and allow for delays due to traffic, public transport and other factors.
In the event of late arrival, the agreed service cannot be provided and admission to the attraction cannot be granted. The ticket expires and there is no entitlement to reimbursement of the agreed remuneration.
12. Final provisions
Should individual provisions not become part of the contract in whole or in part or be invalid, § 306 BGB shall apply.
